1. Platform Description & Marketplace Status

DentalHire NC is an online job board and marketplace that connects dental professionals seeking employment with dental practices in North Carolina. We are not a staffing agency, employment agency, or recruiter as defined under North Carolina General Statutes.

DentalHire NC:

• Does not employ any dental professionals listed on the Platform
• Does not guarantee job placement or hiring outcomes
• Does not independently verify the credentials, licenses, or qualifications of dental professionals
• Is not a party to any employment, independent contractor, or staffing agreement formed through the Platform
• Does not set wages, working conditions, or terms of employment between practices and professionals

Any employment relationship formed through connections made on DentalHire NC is solely between the dental practice and the dental professional. DentalHire NC bears no responsibility or liability for the conduct, performance, or compliance of either party.

2. Eligibility & Account Requirements

To use DentalHire NC, you must:

• Be at least 18 years of age
• Be legally authorized to work in the United States
• Provide accurate, truthful, and current information when creating a profile or posting a job
• Operate within or seek employment within the state of North Carolina

You are responsible for maintaining the accuracy of your information on the Platform. Providing false or misleading information — including false credentials, fake job listings, or impersonation of another person or practice — is grounds for immediate removal from the Platform and may constitute fraud under applicable law.

3. Terms for Dental Professionals

A. Profile Accuracy

By creating a professional profile, you represent and warrant that:

• All information you provide is truthful, accurate, and current
• You hold all licenses, certifications, and credentials you list on your profile
• Your NC dental license (if listed) is valid and in good standing with the North Carolina State Board of Dental Examiners
• You are legally authorized to work in the United States

B. License Compliance

You are solely responsible for maintaining valid licensure and complying with all requirements of the North Carolina State Board of Dental Examiners and any other applicable regulatory bodies. DentalHire NC does not monitor or enforce licensing compliance.

C. Application Consent

When you apply to a job listing, you consent to sharing your name, email address, phone number, and any information included in your application message with the dental practice that posted that listing.

D. Free Membership

Professional profiles and job applications are provided at no charge. DentalHire NC reserves the right to introduce fees for professionals in the future with at least 30 days' advance notice.

4. Terms for Dental Practices

A. Job Posting Accuracy

By posting a job, you represent and warrant that:

• The job listing describes a real, active employment or contracting opportunity
• Your practice is legally operating in North Carolina
• The position described complies with all applicable federal, state, and local employment laws
• You will not use applicant information for any purpose other than evaluating candidates for the listed position

B. Non-Discrimination

Practices agree not to discriminate against any applicant on the basis of race, color, religion, sex, national origin, age, disability, genetic information, sexual orientation, gender identity, or any other characteristic protected by federal, state, or local law, including the North Carolina Equal Employment Practices Act (N.C.G.S. § 143-422.2).

C. Applicant Data Use

Applicant information (name, email, phone, application message) shared with you when a professional applies to your listing may only be used to:

• Evaluate and communicate with that applicant regarding the specific position they applied for
• Comply with legal record-keeping requirements

You may not add applicant contact information to marketing lists, share it with third parties, or contact applicants about any position other than the one they applied for without their explicit consent.

D. Subscriber Access

Subscriber access codes issued to your practice are personal to your practice and may not be shared with other practices, third parties, or the general public. Misuse of subscriber access codes may result in immediate termination of your subscription without refund.

5. Payments, Fees & Refunds

A. Current Fees

• Per Job Listing: $10.00 USD per listing, active for 30 days
• Monthly Subscription: $80.00 USD per month for unlimited job postings and access to browse professional profiles

All fees are in US dollars and are subject to applicable taxes.

B. Payment Processing

Payments are processed by Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service. DentalHire NC does not store your credit card or banking information.

C. Refund Policy

Exceptions may be made at DentalHire NC's sole discretion in cases of documented technical failure on our part that prevented your listing from being published. To request an exception, contact us within 7 days of payment.

D. Subscription Cancellation

Monthly subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period. You will retain subscriber access until the end of the paid period.

E. Fee Changes

DentalHire NC reserves the right to change fees at any time with at least 30 days' notice. Changes will not affect currently active listings or the current billing period for subscribers.

6. Anti-Circumvention Policy

"Circumvention" includes, but is not limited to:

• A dental practice and professional who connected through DentalHire NC agreeing to transact outside the platform to avoid a listing fee
• Sharing subscriber access codes with other practices to obtain profile access without paying
• Scraping or systematically collecting professional contact information from the Platform for use outside the Platform
• Practices contacting professionals via information obtained through the Platform for purposes unrelated to a specific listed job
• Using invitation messages to obtain contact information for off-platform solicitation

Users found to be circumventing the Platform will be subject to:

• Immediate removal of their profile or listings without refund
• Being permanently banned from the Platform
• A circumvention fee of $500 per incident for dental practices, which represents a reasonable estimate of damages to DentalHire NC
• Legal action to recover damages, costs, and attorneys' fees

7. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent job listings or professional profiles
• Misrepresent your credentials, experience, or licensing status
• Impersonate any person, practice, or entity
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Harass, threaten, or abuse other users
• Attempt to gain unauthorized access to other users' accounts or Platform systems
• Use automated tools, bots, or scrapers to collect data from the Platform
• Post any content that is defamatory, obscene, or violates a third party's rights
• Use the Platform to solicit users for services unrelated to dental staffing
• Post listings for positions outside of North Carolina without prior written approval from DentalHire NC
• Collect or store personal data about other users beyond what is necessary for the stated purpose

8. Credential Verification Disclaimer

The presence of a license number on a professional's profile does not constitute verification by DentalHire NC that the license is valid, current, or in good standing. Dental practices are solely responsible for:

• Verifying NC dental license status directly with the North Carolina State Board of Dental Examiners
• Conducting any background checks they deem appropriate
• Verifying employment authorization (I-9 compliance)
• Confirming any certifications, specializations, or software proficiencies claimed by the professional
• Complying with all applicable employment laws, including wage and hour laws

DentalHire NC shall not be liable for any claim, loss, or damage arising from reliance on unverified credential information on the Platform.

9. HIPAA & Patient Privacy

DentalHire NC is not a Covered Entity or Business Associate under HIPAA. Do not submit any patient information, Protected Health Information (PHI), or any other health-related patient data through the Platform under any circumstances.

Dental practices acknowledge that:

• They remain fully responsible for all HIPAA compliance obligations in their practice
• Any dental professional hired through DentalHire NC must be trained on HIPAA requirements before accessing PHI
• DentalHire NC is not a party to and has no obligations under any Business Associate Agreement related to the practice's patient data

Dental professionals acknowledge that they are responsible for complying with all HIPAA requirements imposed by the practices they work with.

10. Intellectual Property

The DentalHire NC name, logo, website design, and original content are the intellectual property of DentalHire NC and may not be copied, reproduced, or used without prior written permission.

By submitting content to the Platform (job listings, profile information, application messages), you grant DentalHire NC a non-exclusive, royalty-free license to display and use that content solely for the purpose of operating the Platform.

You retain ownership of your own content. You represent that you own or have the right to submit all content you post on the Platform.

11. Disclaimers & No Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

DentalHire NC does not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Any job listing will result in a hire
• Any professional will be qualified for or interested in a position
• The information provided by users is accurate, complete, or current
• The Platform will meet your specific requirements or expectations

Use of the Platform is at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DENTALHIRE NC AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Costs of substitute goods or services
• Damages arising from a dental professional's conduct, performance, or malpractice
• Damages arising from a practice's failure to pay wages or comply with employment laws
• Damages arising from reliance on unverified credentials

IN NO EVENT SHALL DENTALHIRE NC'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO DENTALHIRE NC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless DentalHire NC and its owners, operators, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Platform
• Your violation of these Terms
• Any content you post or submit on the Platform
• Any misrepresentation of your credentials or qualifications
• Any employment dispute arising from a connection made through the Platform
• Your violation of any applicable law, regulation, or third-party right

14. Termination

DentalHire NC reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms & Conditions
• Fraudulent, abusive, or harmful conduct
• Failure to pay applicable fees
• Circumvention of the Platform's fee structure
• Providing false information

You may deactivate your profile at any time by contacting us. Termination does not entitle you to a refund of any fees paid.

Sections 6 (Anti-Circumvention), 8 (Credential Verification Disclaimer), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law) survive termination of these Terms.

15. Governing Law & Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Platform shall be resolved as follows:

1. Informal Resolution: You agree to first contact DentalHire NC in writing and attempt to resolve the dispute informally within 30 days.
2. Mediation: If informal resolution fails, both parties agree to attempt mediation in Mecklenburg County, North Carolina before proceeding to litigation.
3. Litigation: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina.

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION against DentalHire NC.

16. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Post a notice on the Site's home page
• Where feasible, notify registered users by email

Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to updated Terms, you must stop using the Platform.
